(1) An investor of an industry which has obtained a permit or registered and is operating in accordance with the prevailing law at the time of commencement of this Act shall not be able to transfer that industry to special economic zone and operate on the basis of such permit or registration. Machines, tools or equipment used by the investor cannot be used or transferred in the special economic sector.
(2) Notwithstanding anything written in sub-section (1), there shall be no hindrance to the transfer of any particular type of industry specified by the Government of Nepal by publishing a notice in the Nepal Gazette to the Special Economic Zone.
